CBA Medal Images
These Terms of Use ("Agreement" govern the use of the medal images ("Assets") provided by the Canadian Brewing Awards ("CBA") to breweries that have been awarded medals in the competition. By downloading, accessing, or using the Assets, you agree to be bound by this Agreement.
Ownership and License:
- The Assets, including all intellectual property rights therein, are the property of the CBA. The CBA grants you a non-exclusive, non-transferable license to use the Assets solely for the purpose of promoting the beer that has been awarded a medal in the Canadian Brewing Awards.
- This license is revocable at any time by the CBA, especially if there is a breach of this Agreement.
Eligibility:
- Only breweries that have been awarded medals in the Canadian Brewing Awards are eligible to use the Assets. The list of winning breweries is available on the official CBA website.
- By using the Assets, you confirm that you are an authorized representative of the brewery listed as a winner in the CBA, or have obtained explicit permission from such an authorized representative.
Permitted Use:
- The Assets may be used on beer labels, packaging, marketing materials, websites, and social media platforms to promote the specific beer that has won a medal in the CBA.
- You may resize, crop, or otherwise modify the Assets as necessary, as long as the integrity and visibility of the medal and associated CBA branding are maintained.
Prohibited Use:
- The Assets may not be used for any purpose other than promoting the beer that has been awarded a medal in the CBA.
- The Assets may not be used to promote other products or brands not directly associated with the winning beer.
- The Assets may not be used in a manner that implies endorsement, sponsorship, or affiliation with the CBA, other than to acknowledge the medal won in the competition.
- The Assets may not be used in any way that is defamatory, misleading, or derogatory towards the CBA or its affiliated entities.
Attribution:
- When using the Assets, you must clearly and visibly credit the Canadian Brewing Awards by including the official CBA logo or text acknowledgment adjacent to or in proximity to the medal image.
- The CBA logo and acknowledgment text will be provided along with the Assets and must be used in accordance with the provided guidelines.
Termination:
- The CBA reserves the right to terminate this license and your access to the Assets at any time and for any reason.
- Upon termination, you must immediately cease using the Assets and remove them from all beer labels, packaging, marketing materials, websites, and social media platforms.
Disclaimer:
- The Assets are provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- The CBA shall not be liable for any damages, including direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Assets.
Modifications:
- The CBA reserves the right to modify or update these Terms of Use at any time without prior notice. It is your responsibility to review this Agreement periodically for any changes.
Governing Law:
- This Agreement shall be governed by and construed in accordance with the laws of Canada. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Canadian courts.
By downloading, accessing, or using the Assets, you acknowledge that you have read, understood, and agreed to abide by these Terms of Use.
